These Terms of Service (“Terms”) govern communications and transactions between you (“Client,” “You,” or “Insured”) and Blue Moon Insurance Services, Inc. (“Agency,” “We,” “Us,” or “Our”). By communicating with our office by email, phone, text, or any other means, you acknowledge and agree to the following:

1. Binding and Changes to Coverage

• Coverage cannot be bound, changed, or cancelled by voicemail, email, text message, fax, or any other electronic communication unless you have received written confirmation from an authorized representative of our agency.

• No coverage, binder, or change should be assumed effective until confirmed in writing by us or by the insurance carrier.

2. Client’s Responsibility to Follow Up

• It is your responsibility to follow up with our office if you do not receive written confirmation of any requested change within a reasonable time.

• The Agency is not responsible for delays or non-receipt of communications due to spam filters, system errors, or other technical issues beyond our control.

3. Quotes and Proposals

• All quotes are subject to underwriting approval and verification by the insurance carrier.

• Premiums, terms, and coverage are not final until a policy or binder is issued.

• Quotes may change based on updated information, inspections, or underwriting guidelines.

4. Claims Reporting

• Claims should be reported directly to the insurance carrier whenever possible using the carrier’s 24-hour claims phone number or website.

• Reporting a claim to our agency does not guarantee that coverage applies or that the claim has been filed with the carrier until confirmed in writing.

5. Electronic Communications

• Communications via email or text are not encrypted and may be subject to interception or delay.

• By communicating electronically, you acknowledge these risks and authorize us to correspond with you by such means.

6. Payment of Premiums

• Payments are not considered received until confirmed by the carrier or premium finance company.

• Do not send cash through the mail. Late or non-payment may result in cancellation by the carrier without further notice.

7. Limitation of Liability

• The Agency’s liability for any error, omission, or negligence shall not exceed the amount of the applicable insurance premium for the policy involved.

• We are not responsible for losses arising from delays, miscommunications, or carrier actions beyond our control.

8. Privacy and Confidentiality

• We maintain your personal information in accordance with applicable privacy laws and our Privacy Policy (available upon request).

• We do not sell or share client data except as required to provide insurance services or comply with legal obligations.

9. Governing Law

These Terms are governed by the laws of the State of California. Any dispute arising under these Terms shall be resolved in Los Angeles County, California.
